Requirements for a valid Takedown Notice
In order for a takedown notice to be effective, it must include the following elements, as required by the DMCA:
- A physical or electronic signature of the copyright owner or their authorized agent.
- An identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with enough detail so that we may locate it on the site.
- Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and if available, an electronic mail address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Process After Submission
Upon receiving a compliant notice, California PDF Forms will take appropriate action to remove or disable access to the allegedly infringing material. We will also notify the content provider, member, or user of the action taken to address the alleged infringement.
Counter-Notification
If you receive a notification from California PDF Forms about an alleged infringement due to your content, and you believe this is in error, you have the right to submit a counter-notification. Your counter-notification must be in writing and include the following:
- Your physical or electronic signature.
- A description of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which California PDF Forms may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
If a valid counter-notification is received by our DMCA Agent, we may, at our discretion, send a copy of the counter-notification to the original complaining party, informing them that we may replace the removed content or cease disabling it in 10 business days. Unless our agent receives notice from the original complainant that an action has been filed seeking a court order to restrain you from engaging in infringing activity relating to the material on California PDF Forms, the disputed content may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice, at our discretion.
